Collection Due Process (CDP) or Equivalent Hearing

If you have received a Notice of Intent to Levy or Federal Tax Lien Filing, contact us right away. We may be able to stop the levy or lien from taking effect.

After the IRS has issued its Final Notice of Intent to Levy or Federal Tax Lien Filing, it must wait 30 days before beginning any action. During the 30-day window, we can request a meeting on your behalf with an IRS appeals officer. This is referred to as a Collection Due Process (CDP) hearing. The appeals officer will attempt to reach a payment agreement as an alternative to proceeding with a levy. Once we request a CDP hearing, the IRS will cease further collection actions.

CDP is available only when you have received one of the following types of notices:
 

  • Notice of Federal Tax Lien Filing and Your Right to a Hearing
  • Final Notice - Notice of Intent to Levy and Notice of Your Right to a Hearing
  • Notice of Jeopardy Levy and Right of Appeal
  • Notice of Levy on you State Tax Refund - Notice of Your Right to a Hearing
  • Notice of Levy and Notice of Right to a Hearing with Respect to a Disqualified Employment Tax Levy
 

If you missed the deadline for requesting a CDP hearing, we can request an “equivalent hearing” on your behalf. This must be requested in writing and postmarked on or before the end of the one-year period after the date of the levy notice, or on or before the end of the one-year period plus 5 business days after the filing date of the Notice of Federal Tax Lien.

A request for a CDP or equivalent hearing must include your reasons for disagreeing with the lien or levy action and identify an alternative way to pay such as:
